In a significant development within Ghana’s judiciary, President John Dramani Mahama has dismissed the Chief Justice, Her Ladyship Justice Gertrude Araba Esaaba Sackey Torkonoo, with immediate effect.
The decision was carried out under Article 146(9) of the 1992 Constitution following the submission of a report by a Committee established under Article 146(6). The Committee had been tasked to probe a petition lodged by a Ghanaian citizen, Mr. Daniel Ofori, alleging misconduct by the Chief Justice.

After its investigations, the Committee determined that the claims were valid and that the requirements for removal as set out in Article 146(1) had been satisfied. It therefore recommended her dismissal.
In line with constitutional provisions, the President was bound to act on the Committee’s report. A statement issued from the Presidency, signed by Hon. Felix Kwakye Ofosu, Member of Parliament and Presidential Spokesperson, confirmed that President Mahama had duly implemented the recommendation.
Justice Torkonoo, who assumed the role of Chief Justice in 2023, now holds the distinction of being the first in the Fourth Republic to be removed under this constitutional process.
